ASUU has been ordered by the court to resume classes immediately.
The Academic Staff Union of Universities must start working again right away, according to the Abuja Division of the Court of Appeal.
The appellate court issued the ruling today while granting ASUU permission to appeal Justice Polycarp Hamman’s interlocutory injunction, which ordered union members to return to work on September 21, 2022.
ASUU was cautioned by Justice Hamma Barka’s court that if it disobeyed the order, it would immediately forfeit its right to appeal the lower court’s decision.
The application by ASUU for a stay of execution of the order of the Industrial Court was, however, struck out by the court on the basis of a petition by the applicant’s counsel, Femi Falana (SAN), for the application to be withdrawn. This caused the application to be invalid.
Justice Hamma Barka, the head of the three-person panel, read the main decision. He told ASUU that it had seven days to file a notice of appeal against the decision of the lower court.
